Plus an $120 Compliance Fee applicable to all Survivorship Application matters.
For a survivorship application only, where a joint tenant is removed from the title following their passing.

Probate Estate Transfers

$1,450

Plus a $120 Compliance Fee applicable to most Probate Estate transfer matters.
For situations where Probate or Letters of Administration have already been granted and property ownership needs to be transferred to beneficiaries or sold as part of the estate.

Government & Third-Party fees

Certain government and third‑party charges are payable in addition to our professional fee. These typically include:

  • Landgate Registration fees – see the Landgate fee schedule

  • Title search fees

  • Local Authority Enquiry fees (if applicable)

  • Government stamp duty – use the online calculator

  • PEXA electronic lodgement fee

  • Verification of Identity & AML Compliance fees – $15 per individual, $35 per company, trust or other entity (if necessary)

Because every estate is different, additional fees may apply where there are multiple beneficiaries, complex ownership structures, trust arrangements, mortgage requirements, or other factors that increase the complexity of the transfer. Any additional costs will be discussed and approved before work commences.

What is a deceased estate property transfer?

A deceased estate property transfer is when ownership of a property is transferred following the death of the owner. This can be to a beneficiary named in the Will, to an executor, or to a buyer if the property is sold as part of finalising the estate.

Do I need probate before transferring a deceased estate property in WA?

In most cases, yes. Probate (or Letters of Administration if there’s no Will) confirms the legal authority to deal with the deceased’s property. There are limited exceptions, such as small estates or where the property was held in joint tenancy. We can advise you on what applies in your situation.

Can Federation Settlements obtain Probate for me?

No. Probate and estate administration are legal processes that must be completed before certain property transfers can occur. If Probate or Letters of Administration are required, a solicitor will generally need to assist. Once the appropriate authority has been obtained, we can help with the property transfer and settlement process.

Can you help with selling a deceased estate property?

Yes. We handle the settlement process for sales of deceased estate properties, including preparing and lodging all necessary documents, coordinating with agents and buyers, and ensuring settlement meets all legal requirements.

Is transfer duty payable on a deceased estate property transfer?

In WA, transfers to beneficiaries under a Will or in accordance with intestacy laws are generally exempt from transfer duty. We prepare and lodge the necessary RevenueWA exemption forms as part of your matter.

How long does a deceased estate property transfer take?

Timeframes vary depending on probate processing times, lender involvement, and the complexity of the estate. Once probate is granted and all documentation is in order, the transfer or sale can often be finalised within 4–6 weeks.
