FAQs

What is a bare trust property transfer?

A bare trust property transfer generally refers to transferring ownership of a property held by a bare trustee to another entity, often the trustee of a self-managed super fund (SMSF). These transfers commonly occur when a limited recourse borrowing arrangement (LRBA) has been repaid and the property is ready to be transferred into the SMSF trustee’s name.

When should a property be transferred from a bare trust to an SMSF?

This usually occurs after an SMSF loan has been fully repaid and your accountant or financial adviser confirms the property is ready to be transferred from the bare trustee to the SMSF trustee. The timing depends on your fund structure and professional advice, so we recommend obtaining confirmation from your accountant before proceeding.

Can Federation Settlements transfer property after an SMSF loan is repaid?

Yes. We regularly assist with transferring property from a bare trust structure to the SMSF trustee once the loan has been repaid. We coordinate the transfer process, prepare the required documentation, and work alongside your accountant, lender, and other advisers to help ensure the transfer is completed correctly.

Do I need my accountant involved in an SMSF property transfer?

In most cases, yes. While we handle the conveyancing and transfer process, your accountant or financial adviser should confirm the appropriate ownership structure, trustee details, and any taxation or superannuation considerations. We are happy to work directly with your advisers throughout the transaction.

Will transfer duty apply?

Transfer duty treatment depends on the nature of the transfer and whether any exemptions or concessions are available. Many SMSF and bare trust transfers qualify for concessional duty treatment, but every matter should be reviewed individually. We can assist with the transfer documentation and duty assessment process, however taxation advice should be obtained from your accountant or adviser.

How long does an SMSF or bare trust transfer take?

Timeframes vary depending on the parties involved, lender requirements, and whether additional documentation is required. Once we receive all necessary information and approvals, most straightforward transfers can usually be completed within a few weeks. More complex matters may take longer.

Can you assist with trustee changes?

Yes. We can assist with property transfers that arise from changes to trustees, including SMSF trustee restructures and related title updates. Because trustee arrangements can vary significantly, we recommend contacting us to discuss your circumstances so we can confirm the requirements and provide a tailored quote.

Do you provide SMSF or tax advice?

No. We are conveyancers and handle the property transfer and settlement process. We do not provide financial, taxation, or legal advice. Where advice is required, we work alongside your accountant, financial adviser, or solicitor to ensure the transaction proceeds correctly. We also have trusted professionals in these spaces that we can refer you to if required.
